These terms apply when you use Mergly. By creating an account, you agree to them.
Who you contract with
These terms are a contract between you and Muhammad Hammad, who trades as Mergly and provides the service described here. By creating an account, or by continuing to use Mergly, you agree to these terms.
If you use Mergly on behalf of a company or other organisation, you confirm that you are authorised to bind it to these terms. If you sign up as an individual, you confirm that you are at least 18 years old (or the age of majority where you live).
What Mergly does
Mergly is a dashboard that lets you connect social accounts, plan and schedule content, create captions and images with AI, publish posts to the platforms you select, and reply to messages from one inbox. Features may change as the product develops.
Your account
You are responsible for keeping your login details private and for everything that happens under your account. Give us accurate information and keep it up to date. Tell us promptly at support@mergly.app if you believe someone else has used your account.
Your licence to use Mergly
We give you a limited, non-exclusive, non-transferable right to use Mergly within the plan you have chosen. You may not resell or redistribute the service, copy or reverse-engineer it, or work around plan limits, usage counters or other technical restrictions. Muhammad Hammad keeps ownership of the service, its software, documentation and branding.
Your content
You keep ownership of the text, images and videos you upload. You grant Muhammad Hammad the permission needed to store, process, display and publish that content solely to provide the service to you — including sending it to an AI provider when you ask for a caption, post or image. You are responsible for what you ask the AI to create, for how you use what it returns, for checking that outputs are accurate before you rely on or publish them, and for having the rights to everything you put in.
Acceptable use
Do not use Mergly to:
break the law, deceive people, or commit fraud;
send spam, bulk or unsolicited messages, or DMs that a platform's rules don't allow;
impersonate someone else, or infringe another person's intellectual property, privacy or other rights;
generate illegal material, sexual content involving minors, hate speech, harassment, non-consensual deepfakes of real people, or malware;
try to break into, overload, probe, scrape, or otherwise interfere with the service or another user's account, including uploading malware or attempting to bypass AI safety measures.
AI content, moderation and takedowns
AI results can be inaccurate, incomplete or unsuitable for regulated professional advice without a qualified person reviewing them. You decide what gets published.
We can remove or restrict content, refuse or filter AI outputs, and suspend accounts where it is needed to protect the service or its users.
If you are a rights-holder and content on Mergly infringes your rights, email support@mergly.app with what you own, where it appears, and your contact details. We act on valid reports, and repeat infringement leads to suspension or termination.
Publishing to social platforms
You must follow the rules of each social platform you connect, and only post what you have the right to share. Platforms can reject, delay or limit posts, and can withdraw their own permissions at any time. Mergly does not control their decisions.
Plans, trials and billing
Mergly is offered on monthly plans: Starter at $29, Growth at $50 and Unlimited at $80, in US dollars, each starting with a 7-day free trial that requires a card. Unless you cancel before the trial ends, you are charged for the first month, and the plan then renews each month until cancelled. Upgrades take effect immediately with a prorated charge; downgrades and cancellations take effect at the end of the period you have already paid for. Taxes are added where required.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Availability
We work to keep Mergly running, but we do not guarantee uninterrupted or error-free service. Occasional maintenance, platform outages and rate limits are part of using third-party services.
Suspension and termination
You can close your account at any time. We can suspend or end your access for a material breach of these terms, for non-payment, for a security or fraud risk, or for repeated or serious policy violations. We will tell you why, unless the law or an investigation prevents us.
When your access ends
Export anything you want to keep before closing your account. Once it is closed, your posts, uploads and stored platform permissions are deleted; copies held in routine backups expire on their own schedule. Plan limits stop applying as soon as your subscription ends.
Warranties and liability
Mergly is provided as-is, and to the fullest extent the law allows we disclaim implied warranties such as merchantability and fitness for a particular purpose. We are not responsible for lost profits, lost data or lost goodwill, or for posts removed, rejected or limited by a social platform. Our total liability for anything arising from these terms is capped at the fees you paid us in the six months before the claim. This never excludes liability that cannot lawfully be excluded, such as for fraud, death or personal injury.
Your indemnity
You will cover Muhammad Hammad against claims that come from your content, your use of the service in breach of these terms, or your breach of a platform's rules or someone else's rights.
Changes and assignment
We may update these terms and will post the new version here with a new date; material changes are announced in the app. You cannot transfer these terms without our consent; we may assign them in a merger or sale. If a court strikes part of these terms, the rest still stands.
